These Terms of Service (“Terms”) govern your access to and use of the services provided by NXTLVL AI Solutions LLC (“we,” “us,” or “our”), including our website at mynextlevel.ai, AI conversational assistants, voice calls, SMS/text messaging, chat, social DMs, booking tools, and related features (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Our Services

We provide AI-powered conversational assistants designed to handle customer inquiries, answer questions, resolve issues, and facilitate bookings for experiences (such as at zoos, attractions, or similar venues). Services may include real-time responses via voice, SMS/text, chat, or other channels.

We may use third-party providers, including messaging platforms like Twilio, to deliver SMS communications.

2. SMS Messaging Program

We offer an SMS messaging program as part of our Services to send notifications, alerts, booking confirmations, reminders, customer support responses, and occasional updates to users who have explicitly opted in.

Program Description: This SMS program delivers transactional and service-related messages, including AI-assisted responses to your inquiries, booking details, and follow-ups. Message frequency varies based on your interactions and may include 1–5 messages per month or as needed for ongoing support.

Message and Data Rates: Message and data rates may apply according to your mobile carrier plan. We do not charge additional fees for receiving our SMS messages beyond standard carrier rates.

Carriers Are Not Liable: Carriers are not liable for delayed or undelivered messages.

3. Consent and Opt-In

You must provide explicit consent before we send you SMS messages. Consent is obtained through clear opt-in mechanisms on our website, forms, or other channels (e.g., checking a separate, unchecked box or texting a keyword).

By providing your mobile number and consenting, you agree to receive SMS from NXTLVL AI Solutions LLC.

We do not solicit opt-ins via SMS without prior consent.

4. Opt-Out Instructions

You can opt out of our SMS program at any time. To stop receiving messages:

• Text STOP to the number from which you received our messages.

Upon opting out, we will send a confirmation message and cease non-transactional SMS communications (transactional messages required for ongoing service may continue until resolved).

Opt-Out Confirmation: After texting STOP, you will receive one final message confirming your opt-out.

5. Privacy and Data Practices

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information, including mobile numbers and SMS-related data.

We do not sell, rent, or share your mobile information or opt-in consent data with third parties or affiliates for marketing or promotional purposes, except as necessary to provide the Services or as required by law. Mobile information will not be used for any other purpose beyond the consented SMS program.

6. User Responsibilities and Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws.

Prohibited activities include (but are not limited to):

• Sending or requesting unlawful, harmful, abusive, or fraudulent content.
• Attempting to circumvent consent or opt-out mechanisms.
• Using automated means to interact with the Services in violation of our policies.
• Any use that violates Twilio’s or carrier messaging policies.

We reserve the right to suspend or terminate access for violations.

7. Intellectual Property

All content, AI models, branding, and materials on our Services are owned by or licensed to NXTLVL AI Solutions LLC. You may not copy, modify, or distribute them without permission.

8. Disclaimers and Limitations of Liability

The Services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free operation, including SMS delivery (which depends on carriers).

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.

9. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes by posting the new Terms on our website. Continued use after changes constitutes acceptance.

10. Governing Law and Contact

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of laws principles.
